Court Victory in Thessaloniki: Convictions Set Aside and New Trial Date Ordered
Court Victory in Thessaloniki: Convictions Set Aside and New Trial Date Ordered
Before and after our defence: From a conviction to a new hearing before the Single-Member Court of Appeal for Felonies of Thessaloniki
Before and After Our Defence
Before our intervention: The defendant was in custody, was not transferred to court for the hearing, and was subsequently sentenced in absentia to 8 years' imprisonment and a €2,000 monetary penalty, without being present to defend himself.
After our intervention: We undertook the defence of the client and filed an application seeking the annulment of the proceedings. The Single-Member Court of Appeal for Felonies of Thessaloniki accepted the application, set aside the penalties imposed, and scheduled a new hearing, allowing the substance of the case to be examined again.
Successful Intervention in a Criminal Law Case
Upon undertaking the defence, we acted immediately by filing an application for the annulment of the proceedings, which we subsequently argued before the Single-Member Court of Appeal for Felonies of Thessaloniki.
Outcome of the Court Proceedings
The Court accepted our legal arguments and proceeded to issue a number of significant rulings.
Application for Annulment Granted
The application for the annulment of the proceedings was fully upheld, paving the way for a new hearing of the case.
Convictions and Penalties Set Aside
The previously imposed penalties were set aside, safeguarding the procedural and defence rights of our principal.
New Hearing Date Ordered
A new hearing date was scheduled in order for the merits of the case to be reconsidered, giving our principal the opportunity to present a renewed defence before the Court.
